1. Acceptance of Terms

By accessing or using Bea, Bea Connect, Bea Insight, or any related services provided by Cognitive Scientific, LLC (“Cognitive Scientific,” “Company,” “we,” or “us”), you agree to these Terms & Conditions. If you do not agree, you should not use the app or services.

2. Description of Services

Bea is a behavioral encouragement, accountability, and support platform designed to help users track self-reported information related to stability, wellness, recovery, engagement, and support.

The app may allow users to:
- Have sponsees complete periodic check-ins;
- Share selected information with sponsors, family members, professionals, or invited observers;
- Receive encouragement, reminders, and accountability prompts;
- Support communication between individuals and their support network.

3. Not Medical, Clinical, Legal, or Emergency Advice

Bea is not a medical provider, mental health provider, healthcare provider, crisis service, legal advisor, or emergency response system.

The app does not diagnose, treat, cure, or prevent any disease, mental health condition, substance use disorder, or medical condition.

No information provided through the app constitutes medical advice, psychiatric advice, psychological advice, therapy, counseling, legal advice, or clinical treatment.

Information provided through the app is for support, accountability, educational, and informational purposes only. Users should consult licensed professionals for medical, mental health, legal, or clinical advice.

No provider-patient, therapist-client, sponsor-sponsee, fiduciary, or treatment relationship is created between Cognitive Scientific and any user through use of the app.

4. Emergency and Crisis Disclaimer

Bea is not intended for emergencies or crisis situations.

If you or someone else may be in danger, experiencing a medical emergency, psychiatric emergency, suicidal thoughts, overdose risk, or any other urgent crisis, call 911, go to the nearest emergency room, or contact the 988 Suicide & Crisis Lifeline immediately.

Do not rely on Bea for emergency monitoring, wellness checks, crisis intervention, suicide prevention, overdose prevention, mandatory reporting, or real-time safety response.

Cognitive Scientific does not monitor user activity in real time and cannot guarantee intervention, escalation, or response to missed check-ins, concerning behavior, or reported information.

5. User Responsibility

Users are solely responsible for the accuracy, completeness, and truthfulness of information they submit.

Cognitive Scientific is not responsible for decisions made based on incomplete, inaccurate, delayed, misleading, or omitted user-reported information.

Users agree not to misuse the app, submit false information intentionally, harass others, violate laws, impersonate another person, or interfere with the app’s operation.

6. Support Network and Information Sharing

Depending on the subscription level and user permissions, Bea may allow information to be shared with sponsors, family members, professionals, referral sources, or other invited observers.

Users are responsible for:
- Choosing who they invite;
- Determining what information they share;
- Managing permissions and visibility settings.

Cognitive Scientific does not guarantee that invited observers will review, respond to, act on, or appropriately interpret information shared through the app.

Observers are independently responsible for their own decisions and actions.

7. Privacy and Data Use

Use of Bea is also governed by our Privacy Policy, which explains how information is collected, used, stored, processed, and shared.

Cognitive Scientific intends to store user data in a HIPAA-compliant fashion using appropriate administrative, technical, and physical safeguards designed to protect sensitive user information.

By using Bea, users consent to the collection and use of information as described in the Privacy Policy.

Users acknowledge that electronic communications and cloud-based systems carry inherent security risks, and no platform can guarantee absolute security.

8. California Privacy Rights

If you are a California resident, you may have certain rights under California law, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

Subject to applicable law, California users may have rights to:
- Request access to personal information;
- Request correction of inaccurate information;
- Request deletion of personal information;
- Limit certain uses of sensitive personal information;
- Request information about categories of collected or disclosed data.

Cognitive Scientific will provide applicable disclosures and rights mechanisms required by California law.

9. HIPAA-Compliant Data Storage and Healthcare Disclaimer

Cognitive Scientific intends to store user data in a HIPAA-compliant fashion using appropriate administrative, technical, and physical safeguards designed to protect sensitive user information.

However, Bea is not intended to function as a HIPAA-covered healthcare provider platform unless expressly stated in a separate written agreement.

Users should not assume that Cognitive Scientific is acting as a healthcare provider, covered entity, or business associate under HIPAA unless specifically disclosed by Cognitive Scientific in writing.

Use of the app does not create a provider-patient, therapist-client, or clinical treatment relationship between Cognitive Scientific and any user.

10. Eligibility

Users must be at least 18 years old to create an account unless otherwise permitted through a parent, guardian, provider, or authorized account structure.

If services are made available to minors, additional consent, privacy, and legal requirements may apply.

11. Subscriptions and Payments

Certain features may require a paid subscription. Subscription fees, billing cycles, cancellation terms, renewal terms, and refund policies will be disclosed at the time of purchase.

Payments may be processed through Stripe, Apple App Store, Google Play, or another approved payment provider.

Users are responsible for managing cancellations through the platform where the subscription was purchased.

12. No Guarantee of Outcomes

Cognitive Scientific does not guarantee recovery, sobriety, stability, treatment success, improved relationships, reduced relapse risk, reduced hospitalization risk, or any specific behavioral health outcome.

Bea is a support tool only and should be used as part of a broader support system when appropriate.

13. Limitation of Liability

To the fullest extent permitted by law, Cognitive Scientific, LLC and its officers, employees, contractors, affiliates, advisors, licensors, and partners are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the app.

This includes, but is not limited to:
- Reliance on user-reported information;
- Missed check-ins or notifications;
- Delayed communications;
- User misconduct;
- Decisions made by users or observers;
- Technical outages or failures;
- Loss of data;
- Emotional distress;
- Injury, relapse, hospitalization, overdose, or death.

14. Assumption of Risk

Users voluntarily assume all risks associated with using the app and participating in behavioral accountability, recovery, or support-related activities.

Users acknowledge that behavioral health and recovery outcomes involve inherent uncertainty and risk.

15. Account Security

Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account.

Users should notify Cognitive Scientific immediately if they believe their account has been accessed without authorization.

16. Prohibited Uses

Users may not:
- Use the app for unlawful purposes;
- Submit false, misleading, abusive, or harmful content;
- Attempt to access another user’s account;
- Reverse engineer, disrupt, or interfere with the app;
- Use the app as a substitute for emergency care, clinical care, or professional judgment;
- Upload malicious code, malware, or harmful material.

17. Intellectual Property

All content, software, branding, designs, trademarks, logos, text, graphics, and technology associated with Bea and Cognitive Scientific are owned by or licensed to Cognitive Scientific, LLC.

Users may not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any portion of the app without written permission.

18. Third-Party Services

The app may integrate with or rely upon third-party services, including payment processors, analytics providers, cloud hosting providers, app stores, communication tools, or referral systems.

Cognitive Scientific is not responsible for third-party services, policies, outages, or actions.

19. Changes to Terms

Cognitive Scientific may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.

20. Termination

Cognitive Scientific may suspend or terminate access to the app if a user violates these Terms, misuses the service, creates risk for others, or engages in unlawful conduct.

21. Arbitration and Dispute Resolution

To the fullest extent permitted by law, disputes arising from use of the app shall be resolved through binding arbitration in California, except where prohibited by law.

Users waive the right to participate in class actions or jury trials to the extent permitted by applicable law.

22. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
